" Processing" means an operation or set of operations that is performed on personal data or on data sets

personal data in an automated or non-automated manner, such as collecting, recording, organizing,

ordering, storing, adapting or modifying, downloading, browsing, using,

disclosure by sending, distributing or otherwise sharing, matching or combining,

limiting, deleting or destroying (GDPR - art.4 point 2)

Pursuant to Art. 6 GDPR, processing is lawful when:
1) the data subject has consented to it,
2) it is necessary to perform the contract or take action before its conclusion,
3) it is necessary to fulfill the legal obligation imposed on the administrator,
4) it is necessary to protect the vital interests of the data subject or another natural person,
5) is necessary for the performance of a task carried out in the public interest or in the exercise of public authority,
6) it is necessary for the purposes of legitimate interests.

  REGULATION OF THE MINISTER OF EDUCATION  NATIONAL   of August 9, 2017 on the rules  organization and providing psychological and pedagogical help in public  kindergartens, schools and institutions

  • Act on the educational information system

  • REGULATION OF THE MINISTER OF NATIONAL EDUCATION of August 28, 2017 on the types of other forms of pre-school education, the conditions for creating and organizing these forms and the manner of their operation

  • Consent of the data subject

The recipients of personal data are:

  • Entities to which personal data should be made available on the basis of legal provisions, entities indicated by legal guardians.

 Personal data will be stored for 50 years from the date of graduation.

The data subject has the right to:

 

  • access to personal data concerning him, rectification, lodging a complaint to the supervisory body

  • information about the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal and deletion or limitation of processing or the right to object to processing, as well as the right to transfer data (applies to data processed on the basis of consent)

 

Each data subject, if the processing is based on consent, has the right to withdraw consent at any time without affecting the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.

Withdrawal from consent must be submitted in the form of an application in writing.

The consequence of withdrawing from consent will be the inability to process data other than those resulting from legal provisions.

 

Providing personal data resulting from a legal provision is a statutory requirement.

Failure to provide this data will result in the inability to perform the tasks of the school / kindergarten.

Decisions regarding the processing of personal data will not be made in  automated way. The administrator does not profile personal data.

 

Personal data is not processed for any purpose other than the purpose for which the personal data was collected.

 

Based on Article. 7 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC,

(for teachers, teaching staff and non-teaching staff of the school, hereinafter referred to as school employees, in connection with obtaining personal data).

In accordance with: the Act of May 10, 2018 on the protection of personal data, Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) I would like to inform you that:

The administrator conducts the processing of the following categories of personal data of employees: name and surname, date and place of birth, residence address, PESEL number, parents' names, mother's maiden name, NIP (tax identification number), ID number and series, e-mail addresses and telephone number, education, profession, career advancement for teachers, names and dates of birth of the spouse and children.   4. Employees' personal data will be processed in connection with the performance of the employment contract concluded with the employee. The recipients of employee data will be entities indicated in the law.

  5. Providing personal data is a statutory requirement and is mandatory due to the provisions of the education law.

  6. The basis for the processing of employees' personal data is the Teacher's Charter, the Education Information System Act, the Labor Code, the Local Government Employees Act, the Regulation of the Minister of Labor and Social Policy on the scope of keeping records by employers in matters related to the employment relationship and the manner of keeping employee personal files .

  7. School staff have the right to:

  8. requests from the administrator to access personal data and rectify them

  9. lodging a complaint to the supervisory body - the President of the Personal Data Protection Office in connection with data processing inconsistent with applicable provisions

  10. withdrawal of consent to the processing of personal data - this applies only to consent to the processing of sensitive data, if such consent has previously been given. Other ordinary personal data of employees are processed as a result of the fulfillment of an obligation resulting from legal provisions.

  11. Employees' personal data will be stored for the period of work at Primary School No. John Paul II and after that time for the period specified in the special regulations.
